These Terms & Conditions govern your use of ELIRD website. In these Terms & Conditions, we use the term ELIRD (and "we", "us", "our" and “elird.com“) to refer to the head office/studio of ELIRD with the registered ID number at the Tax administration of Bosnia and Herzegovina.

Please read these Terms & Conditions carefully before using the elird.com.

By using the elird.com, you signify your assent and agreement to these Terms & Conditions.

If you do not agree to these Terms & Conditions, then you are not authorised to continue use of the elird.com.

When purchasing at elird.com you automatically accept the terms and conditions stipulated below.

Consequently, we recommend that you read the terms through carefully before purchasing.

PAYMENT

All orders from our web shop are processed through PayPal system.

All prices are stated in Euro. It's also possible to pay via banks transfer, in that case please write an email with your order to info@elird.com.

PURCHASE

In order to purchase items at elird.com you must fill in your personal information and payment information. Once your order has been placed you will receive an order confirmation via email. When your purchase has been accepted and the item is registered in our stock, you will receive a shipping confirmation.

BESPOKE AND PERSONALIZED DESIGNS

For bespoke jewellery (i.e. items that are not ready-made on the day of ordering) we require a 50% deposit before proceeding with production. This deposit is non-refundable, regardless of whether the client chooses to continue with the project or not.

Once a bespoke jewellery design is finalized and an estimate for the project is given, please note the estimate can fluctuate within 20% for anything that may have been unforeseen. Once the estimate is approved and a 50% deposit is given, the client is responsible for complete payment of the piece.

Please note that the time required to make a bespoke or personalized design may take few weeks, depending on the complexity of the design.

SHIPPING TO YOUR BUSINESS OR HOME ADDRESS?

We will happily ship to your home address, but for the fastest delivery, we suggest that you use your business address, as there is always someone present to receive your package.   

SHIPPING

All goods from our web shop are sent from Bosnia and Herzegovina and can be shipped worldwide, without charge. All goods are delivered via DHL as parcel post, which makes it possible to trace the parcel. We carefully pack goods in protective boxes to secure that products will arrive in perfect condition. However, if the content is damaged upon receipt, please report this to us immediately or at the latest two (2) days after receipt to info@elird.com.

CUSTOMS DUTY AND VAT

Prices at elird.com do not include local taxes and duties, which may be added and for which we cannot be held responsible. If this is the case the carrier will contact you. Please note that this could involve some delay of the consignment, as the goods are retained by the customs. From this point it is your responsibility to contact the carrier and pay for the added additional costs. These additional costs are solely your responsibility and cannot be used as cause of return.

BROKEN OR DAMAGED PIECES

Should there be any breakage or damage to a piece that is clearly due to a materials flaw or manufacturing / production defect, we can offer exchange within fourteen (14) days of purchase. This is subject to evaluation by our team and we must see the piece in person to assess the issue. You can reach out to us to set an appointment or ship your piece to us for review.

After 14 days, we cannot offer or guarantee exchange.

Remember to save the original product packaging as in the case of a complaint or damage the product must be returned unused in its original packaging.

SECURITY

All communication between our payment system and the cardholder is made through an encrypted SSL-line (Secure Socket Layer). In other words only PayPal has access to your data. It is not possible neither for us nor any other unauthorized entity to see or read data, which is exchanged in connection with the purchase.

COLOURS

We cannot guarantee that colours in the website are fully equivalent to the items’ actual colors. This depends partly on the colour settings of your computer and monitor.

The content on this website is protected by intellectual property rights and belong to ELIRD. Any material on the website, such as images, photographs, including any person represented in the photographs, illustrations, icons, texts, video clips, music, written and other materials, may not be reproduced, and it may not be used commercially without referring to ELIRD.

Shopping at elird.com requires the following information from you, as a minimum: Name, address, telephone number and e-mail address. elird.com only records this information with a view to delivering the items you order and to offer you the best possible shopping experience. Your personal data is stored by ELIRD Studio. Please note: We do not store personal payment information such as card numbers etc., and none of the information we receive from you will be shared with any third parties.

ELIRD Studio is required to protect your privacy and your security as a user of elird.com. The information you provide when you place an order on our website is only used to provide a smooth and simple shopping experience. The data is treated in careful accordance with all current privacy regulations.

No data that identifies the individual shopper is passed on to any third parties. The only statistical data that is collected and shared with any third parties concerns customer traffic and commercial information. This information is shared with the sole purpose of improving your user experience at elird.com.

RETURN POLICY

We offer a seven (7) days refund (excluding shipping costs for the return) upon receipt of the package from our web shop or when purchasing ready to wear jewellery from our studio, if you change your mind. The items must be returned unused and in the same condition as they were upon receipt, in the same original packaging. Note that the right of withdrawal is annulled if you use or damage the product in a way that obviously reduces the sales value significantly.

Returns and exchanges happen at your own risk and expense, and is to be handled by you. If you wish to return an item please contact us at info@elird.com before returning any items, and we will provide you with directions for return. Remember to state your order number and relevant contact information in the e-mail. Please note that the cost of returning the item is to be paid by you.

If returning goods, please clearly mark the package ‘RETURNED GOODS’, to avoid any customs charges. ELIRD is not responsible for any customs charges regarding the returned parcel. Any charges incurred are the responsibility of the customer.

Sale items can not be returned.

Bespoke jewellery items are all final sale and can not be returned. We can improve the existing piece at an additional cost, to be determined upon return.
The client is financially responsible for any changes made to the project once it is complete. We commit to providing the customer with the most information and best advice on bespoke jewellery projects. If our recommendations are disregarded, the customer is financially responsible for any needed repairs or alterations.

RETURNS MUST HAVE A TRACKING NUMBER

A copy of the invoice must be enclosed together with the parcel. The items must be send as a parcel with a Track & Trace number as this guarantees that the items will arrive at their destination. It is not an option to return your order as a parcel without a tracking number.

Please remember to keep your tracking number as a documentation that the items have been sent. We may retain the refund until we have received the returned items or until we have received documentation that the items have been returned, whatever comes first.

REFUND

When we have received the items that may be returned and approved the return, we will transfer the full purchase amount to your account within one (1) to three (3) months, depending on the type of the jewellery purchased. Whether you return all items in your order or you only return part of your order we will only refund the items cost.

APPLICABLE LAW AND JURISDICTION

These Terms & Conditions shall be governed by and construed in accordance with the laws of Bosnia and Herzegovina, without reference to conflict of laws provisions. Any dispute, controversy or claim arising out of or in relation to the Terms & Conditions, including the validity, invalidity, breach or termination thereof, shall be adjudicated or arbitrated in accordance with said Terms & Conditions. Where the laws of Bosnia and Herzegovina are different to the mandatory consumer laws in your own country, we will afford you with similar protection.

UPDATES TO THESE TERMS & CONDITIONS

We may make changes from time to time to these Terms & Conditions so please check back regularly to keep informed of updates. The latest version of these Terms & Conditions will always be available on elird.com. Any new version of these Terms & Conditions shall take effect and will govern the use of elird.com and your relationship with us immediately upon the date of posting. By continuing to use elird.com, you agree to be bound by the terms of these updates and amendments.

JEWELLERY CARE

Our jewellery is carefully crafted with materials made to last. Over time, precious jewellery will naturally tarnish and look dull if not cared for properly. We advise you to follow these recommendations:

Avoid contact with perfume, lotion, oil, hairspray, soap, salt, chlorine or any other fluids and chemicals.
Be gentle! Avoid tugging, pulling and throwing your jewellery.
Take off your jewellery when washing hands, bathing, doing household tasks, sleeping, tanning, going to the beach or doing sports.
Clean your jewellery softly in warm water and let it dry well. Or even better just gently wipe with a soft jewellery cloth.
Store and protect your jewellery when not in use in an air tight bag or jewellery box. Keep it away from sunlight and humid spaces like the bathroom.

Note: We cannot be held responsible for an individual’s allergic reaction, for mishandling, or for natural wear and tear of the product.
